The Gyula Traffic Prosecutor’s Office filed charges for the misdemeanor of negligently causing a fatal road accident, and in its indictment filed a motion to impose a prison sentence suspended for a probationary period and a ban on road driving against a 76-year-old woman from Arménykút, with no criminal record, who caused a fatal traffic accident by failing to give way.
On September 28, 2023, in the early afternoon hours, the elderly woman was driving a car in the residential area of Szarvas, on Dr. Melich János utca from Jókai utca in the direction of Szabadság út. During its progress, the sign “Yield is mandatory!” displayed at the intersection of Dr. Melich János utca and Szabadság út. despite the instructions of a sign, he did not give the victim who was riding a bicycle on Szabadság út the right of way, as a result of which they collided – the Békés County Prosecutor’s Office recalls what happened in its statement. As a result of the accident, the 85-year-old man driving the bicycle suffered multiple serious injuries and died on the spot. There is a direct causal relationship between the injuries sustained during the accident and the victim’s death.
According to the prosecutor’s office, the defendant violated the provisions of Section 28 (2) point b) of the KRESZ, according to which, regardless of the direction of arrival of the other vehicle, priority must be given at the intersection to the vehicle coming from a road on which “Priority is mandatory!” before the intersection. there is a sign for vehicles coming from the crossing.
